Our patent attorneys are experienced in the enforcement and defense of patent infringement suits and other controversies involving technology issues.   In particular, Donald Townsend, one of the founding partners of the firm, is a former Department of Justice litigator with over 15 years of experience specializing in patent infringement suits.

Members of the firm have appeared in federal and state courts across the country.   We understand how important it is to explain complex technical issues to judges and juries in ways they can understand.   As such, we strongly believe in the use of outside experts to help assist us in communicating the issues of the case to the judge and jury in laymen’s terms, and retaining designer’s expert in the field of trial graphics and demonstrations.

The protection of intellectual property may require immediate and decisive action.   For example, the firm may obtain temporary restraining orders and preliminary injunctions for our clients. Conversely, the firm may be retained to block attempts to impose such injunctions against our clients by acting in court, or by coordinated actions in appropriate United States Patent and Trademark Office proceedings, including interferences and public use proceedings.

Townsend & Banta is experienced in litigation counseling, including pre-suit evaluations of patents and other intellectual property rights, and has significant experience in creating licensing arrangements and alternative business solutions.   Although having experience in intellectual property litigation, we understand the costs involved to the client, and thus strongly believe in avoiding the financial and business costs of litigation where possible.   Therefore, if desired by our client, we recommend pursuing alternative dispute resolution techniques, when possible, to resolve intellectual property disputes more efficiently.
